Hospital Settles Whistleblower Case for $12.2 Million
False Claims Act Suit
Whistleblower/qui tam cases brought under the federal False Claims Act (FCA) typically involve direct, illegal claims for reimbursement under government programs such as Medicare and Medicaid. Sometimes, however, the alleged fraud is more complicated as a recent case illustrates. In it, a hospital manipulated federal funding rules for indigent care in order to boost hospital revenues. The scheme continued for many years and allegedly allowed the hospital to receive increases in discretionary Medicaid payments to which it was not entitled. Evans Law Firm was not involved in this case in any way. Our attorneys do, however, have extensive experience with whistleblower/qui tam cases under the federal and California False Claims Acts, including cases of government contractor fraud, Medicare and Medicaid fraud, and whistleblower cases of tax avoidance schemes and securities and investment fraud. If you have credible information for a whistleblower or qui tam case in California, call the Evans Law Firm Inc. today at (415) 441-8669.
The False Claims Act entitles private individuals, acting as whistleblowers or “relators,” to bring private actions against parties who have submitted false claims to the government for reimbursements or contract awards, or, as here, alleged accounting misrepresentations around Medicaid eligibility rules. The relator (or “whistleblower”) in this case was a former county official who became aware of the hospital’s allegedly fraudulent practices. After investigation the whistleblower’s information, the US Department of Justice intervened to prosecute the action on behalf of the government.
