Protecting Minorities From Discriminatory Practices
Fair Housing Act Prohibits Discrimination On Basis Of Race, Color, Religion, Sex Or National Origin
Fighting Against Discrimination
Part of the long history of racism in this country includes discrimination in housing, including the availability of mortgage financing. The federal Fair Housing Act (FHA), 42 U.S.C. § 3601-19 prohibits discrimination in home financing based on race, color, religion, sex or national origin. The California Fair Employment and Housing Act (FEHA), Cal. Gov’t Code §§ 12900-12996, protects even more categories of persons from discrimination in home financing: lenders may not discriminate in California on the basis of race, religious creed, color, national origin, ancestry, physical disability, medical condition, genetic information, marital status, sex, gender, gender identity, gender expression, age, sexual orientation, or military or veteran status.
The consumer attorneys at Evans Law Firm, Inc. can represent you if you believe you have been discriminated against when applying for a residential mortgage or if you believe you are paying higher fees or interest than you should due to any form of discrimination. If you believe you have been subject to any form of discrimination when applying or receiving a home loan, call us today at (415)441-8669. Lenders are subject to various federal and State laws against discrimination beyond the FHA and FEHA; minorities are also protected against discrimination in all lending transactions by the Equal Credit Opportunity Act, 15 U.S.C. §§ 1691-1691f. Our litigators would bring your case under all applicable federal and State statutes and regulations.
One of the largest mortgage lenders in California is Citibank, providing mortgage services as Citi® or CitiMortgage, Inc. Like all lenders in California, Citibank and its affiliates are subject to prohibitions against discrimination in providing home lending services. If you believe you have been discriminated against by Citibank, CitiMortgage, or Citi® or any other lender here in California in the offering, closing or administration of your residential mortgage, call our litigators today. Whenever a consumer is discriminated against on the basis of race or any other minority status, our lawyers pursue all available remedies. Both the FHA and FEHA provide enhanced remedies beyond the actual damages you suffer including injunctive relief (prohibiting lenders from discriminating against others), punitive damages (to punish the lender for discriminatory practices), and attorneys’ fees for bringing your case. 42 U.S.C. §§ 3613(c)(2)(FHA); Cal. Gov’t Code § 12965(b)(FEHA).
