Elder Law: Planning, Prevention, and Protection
May has been designated as National Elder Law Month by the National Academy of Elder Law Attorneys (NAELA), a professional association of lawyers dedicate to improving the quality of legal services provided to older Americans. The aging population in America is exploding and so too the reach of elder law. Use this month to learn more about how elder law can best be used to promote the highest quality of life for you and those you love. The elder law attorneys at Evans Law Firm, Inc. are dedicated to providing the highest quality of legal services for seniors in areas of litigation, planning for the future and the prevention and protection of seniors from all types of elder abuse.
The particular elder law services of our firm are described below. As California lawyers, our elder services are limited to California residents. We provide representation of elder abuse victims and their families against abusers including caregivers, persons acting fraudulently under Powers of Attorney, and against insurance agents and companies for the sale of inappropriate/unsuitable insurance and other investments. We also provide planning and counseling services, described below. Visit our website for a full description of the services we provide. If you have questions, call us today at (415)441-8669.
Protection and Litigation
Our elder attorneys have experience representing victims of elder abuse throughout the State of California. We handle cases involving physical and financial elder abuse, nursing home abuse, and instances where the actions of insurance agents, financial advisors, trustees and other may constitute financial elder abuse. California leads the nation in the protections its laws afford seniors and our elder attorneys know how to pursue your rights and remedies under those laws.
In particular, our San Francisco and California financial elder abuse attorneys at Evans Law Firm, Inc. represent victims in civil actions against all manner of abusers: caregivers, insurance agents and companies, brokers, reverse mortgage lenders, financial advisors, trustees, those acting under Powers of Attorney, and others. If you or someone you know is the victim of financial elder abuse in San Francisco or elsewhere in California, call Evans Law Firm today at 415-441-8669.
On our website you will find the estate planning services our attorneys offer. Our services include legal counseling, Will and trust drafting, preparation of Durable Powers of Attorney, Advance Health Care Directives and other advanced health care authorizations, Conservatorship nominations and more. Details regarding the various planning packages we offer may be found under the Estate Planning selection under our Practice Areas tab.
Our elder abuse attorneys also offer advice on how to prevent elder abuse to yourself or any senior loved one. As a general rule, we advise that if you’re a senior or the loved one of a senior, be cautious in all financial matters. Know that anyone could be a potential financial predator. Report financial elder abuse to the authorities when you first suspect but also seek counsel to pursue all available remedies under California law including the mandatory award to you of attorneys’ fees for bringing your case.
Seek the advice of people you trust. Do not relinquish authority by a Power of Attorney to anyone unless it’s someone you completely trust. (If you do need a Power of Attorney we encourage you to appoint two trusted individuals to act jointly at all times.)
Based on our experience, we can offer advice on day-to-day matters too. Make sure checks are kept in a safe place. If in-home care is required, do a thorough background check on anyone before hiring them. Dependent seniors are often victims of financial elder abuse by caregivers. Keep an eye out for strangers who suddenly become over-involved in a senior’s daily life. Don’t respond to door-to-door or phone or internet solicitations for money; these are the most recurring types of financial elder abuse. Lastly, if you’re a senior, don’t isolate; let loved ones and longtime friends and professionals help you just as you helped them in your younger years. If you’re the loved one of a senior stay involved and maintain daily contact.
The bottom line is that our elder attorneys can help you in a wide variety of elder law matters.
