Help in Marin County

The first calls regarding suspected financial elder abuse should be to the police and Adult Protective Services. There is additional government help for financial elder abuse victims in Marin County. The Marin County District Attorney’s Office (DA) collaborates with many Marin County agencies and community-based organizations to address elder abuse, whether it stems from neglect, physical abuse, or financial fraud. For financial elder abuse cases, the DA’s office is part of the Marin County Financial Abuse Specialist Team (FAST), a multidisciplinary team of public agency representatives and private professionals from the financial services industry. FAST provides forensic assistance in the investigation of complex cases of suspected elder financial abuse.  If you suspect financial elder abuse, call the police, Adult Protective Services, and FAST.

While our Marin County financial elder abuse attorneys always recommend you contact law enforcement and FAST whenever you suspect financial elder abuse, you should also seek the help of counsel. Our lawyers will pursue all available remedies under California law for financial elder abuse victims.  Remedies include restitution (getting your money back), damages, rescission of contracts, and extra damages and awards of attorneys’ fees and costs to the victim.  Law enforcement and public elder abuse agencies are a big help but they are not empowered to pursue all these remedies for you.  If you suspect financial elder abuse in Marin County, call us today.  The time limitations on bringing a suit are strict and relatively short, so you need to act quickly if you have suffered economic loss from financial elder abuse.

What You Can Do To Protect Loved Ones … And Yourself

If you’re a senior or the loved one of a senior be cautious in all financial matters. Isolation is a particular danger.  If you’re a senior, stay close to trusted friends and family and let them help you with any financial decision and the day-to-day monitoring of your accounts.  Stay active in community and support groups and bring a friend or family member to any business meetings you have.  Don’t let anyone pressure you into a quick decision.  Know that anyone could be a potential financial predator.  That’s a hard dose of reality, but true.

Seek the advice of people you trust. If you need a Power of Attorney for financial matters, we recommend that you appoint two trusted individuals so that they always work together on your affairs. The more trusted people you surround yourself with, the safer you.  Do not relinquish authority by a Power of Attorney to anyone unless it’s someone you completely trust.   Make sure checks are kept in a safe place.  If in-home care is required, do a thorough background check on anyone before hiring them.  Avoid sales pitches from insurance agents and advisors unless you have a family member or close friend with you at the time.  Dependent seniors are often victims of financial elder abuse by caregivers or unscrupulous insurance agents or financial advisors who promise help.
