Elder Abuse in Nursing Homes

This practice is known as “resident dumping.” Marin County and California nursing home abuse attorneys at Evans Law Firm Inc. represent nursing home abuse victims throughout California and want to bring the troubling trend of resident dumping to your attention. California Advocates for Nursing Home Reform (CANHR) recently reported that nursing homes are dumping Med-Cal residents in hospitals in increasing numbers and refusing readmission. According to a complaint filed against one nursing home chain, nursing homes do this in an effort to increase revenues and make space for more lucrative Medicare and private pay patients. Under federal law, states must provide a “fair hearing” for nursing home residents who claim that they have been illegally evicted. In the reported case, the nursing home resident prevailed at such a hearing and the California Department of Health Care Services (DHCS) ordered her readmission. The nursing home refused and suit was brought.
Public interest groups such as AARP and the California Long Term Care Ombudsman Association (CLTCOA) are joining in the fight against illegal nursing home evictions. These illegal evictions are an example of the extreme forms of nursing home abuse seniors often suffer. California nursing home abuse attorney Ingrid Evans represents families and victims of nursing home abuse throughout California. Nursing home abuse includes neglect, physical and emotional abuse, abandonment, eviction, negligent and reckless care, overmedication, denial of services, and sexual abuse. As Kelly Bagby of AARP Foundation Litigation stated, “Resident dumping is a growing trend and serious danger to seniors in California. Until the State does something, our only recourse is going to be filing suits like this. Three years ago the federal government told California that it had to enforce these orders, and it has done nothing. The time has come for the State to protect its elderly citizens and stop this abusive practice.”
