In one horrific California case[1], an 88-year old man was ultimately killed by his caregiver who first took his home and drained his bank account of over $600,000 in cash.  The victim’s body still has not been found though the caregiver was convicted of his murder and elder abuse, grand theft, embezzlement and forgery.  Before she killed the elderly man, the caregiver managed to get him to deed his house to her, change his estate plan to put her in charge of everything, and add her as a joint owner of his bank accounts.  The caregiver was employed when the victim’s wife was still alive and after the spouse’s death, she managed to take everything the widower had before she killed him.  Sadly, our litigators have seen other cases like this one.

The case illustrates the extreme danger when an evil caregiver enters an isolated senior’s life. If you have a senior loved one, guard against this kind of tragedy as best you can by taking some important steps.  Stay involved in the senior’s life and drop by as often as you can unexpectedly.  Speak to them alone and don’t allow the caregiver to lurk about when you talk to your loved one.  Keep confidential information like Social Security numbers and bank account information hidden.  Never ever allow the senior to give a Power of Attorney to a caregiver.  If you suspect abuse, notify authorities but also reach out to elder abuse counsel immediately.
