Insurance Fraud Overview

Don’t let fear of the future cause you to be vulnerable to insurance fraud. Insurance is a vital component of any investment plan, but also one that is complicated. Today there are insurance choices for almost any eventuality (health, long-term care, life, property). Annuities are popular investment vehicles, but are not appropriate for all investors. The cost of your premium or buy-in is only a small part of what should be considered when purchasing insurance. An insurance agent or financial advisor may promise you a perfect solution without explaining the financial trade-offs necessary to get it.

The Evans Law Firm handles cases for victims of insurance fraud. Insurance fraud can encompass a broad range of deceptive practices and/or insurance products or services. Insurance fraud can be committed by an insurance agent that misrepresents an insurance product to a consumer in order to generate a commission, bad faith by an insurance company when they wrongfully deny a claim or treatment, or fraud by an insurance company when they sell a product to a consumer without full and complete disclosure of the disadvantages of the product. Some examples of insurance fraud include:

  • insurance, financial or banking products/investments that do not accurately or fully disclose surrender charges, or other penalties or that misrepresent or include an illusory bonus or death benefit that penalizes the deceased and his/her family such as with deferred annuities

  • long term care insurance fraud, against insurance companies and agents for long term care insurance abuses.  If your premiums have been raised to an unconscionable price, contact us.

  • health insurance companies/hmo’s/ppo’s that pay unfair or larger and potentially unjustified reimbursement rates for certain services or for in network providers than for out of network providers (see Health Administration Responsibility Project www.harp.org);

  • discriminatory practices in the issuance of insurance policies and the amount of premiums being charged to minorities, women or other protected groups of people or refusal to issue policies or denial of claims for protected classes of people;

  • insurance agents that “churn” or replace insurance policies without justification in order to generate commissions for themselves; or

  • fraudulent billing practices that result in a consumer or the government paying more than they should (including Medicare and Medicaid fraud)
